Information about Business Debt Hibernation
The COVID-19 (Economic Response) Act 2020 provides businesses limited protection from creditor enforcement for three months. Businesses eligible for this protection include companies, partnerships, sole traders, and any other bodies whether incorporated or not. To obtain this protection your business must file a BDH Notice in the Covid Registry. The first step to take is to create an account with the registry. If your business is a company you must be registered or re-registered under the new Company Act 2017. If you have already established an account with the Company Registry then you do not need to create a new client account, you may simply log in under your Company account and then file the BDH Notice from your dashboard. If you are a partnership or a sole trader you must
create an account. After you have filed a BDH Notice, you may later enter into a binding Arrangement with Creditors, which can extend the business debt hibernation after the initial 3 months is up. A Notice of Arrangement is also filed in the Covid registry. For further details on the BDH, the Arrangement, and other protections found in the Act, please visit this Fact Sheet
